Goals This course aims to evaluate the legal terminology on migration, legal classification of migratory movements, regulation of migratory movements within legal systems, interaction between human rights law and migratory movements on a basic level.
Course Content Within the context of the objective of the course, the course will mainly cover the following issues: universal and regional international conventions regarding migration, readmission agreements, relevant and significant EU legislation and practice, selected relevant topics under human rights law (e.g. non-refoulement principle, family Reunion, prohibition on mass deportation…), relevant case law of European Court of Human Rights, relevant constitutional principles of Turkish law, relevant case law of Constitutional Court of Turkey, trafficking in human beings and migrant smuggling.
Learning Outcomes 1) Lists the concepts and sources of Immigration Law
2) Researches and evaluates the literature regarding Immigration Law
3) Evaluates the theoretical basis of Immigration Law and demonstrates its interactions with other disciplines
4) Lists and discuses the problems faced during the practice of immigration law
5) Evaluates the legal tools of Immigration Law (including case law)
6) Initiates the fundamental sources and concepts and research findings of Immigration Law with relevant contemporary problems and makes predictions about the future.
