Goals It is aimed to teach the establishment and scope of usufruct rights on land, the establishment and scope of superficies on land, the establishment and scope of mortgage rights on land.
Course Content Changes in the present land law system from the Ottoman Empire to the present, the evaluation and comparison of the development of land law in selected countries and the Turkish Legal System, the current situation analysis in Türkiye: Analysis of Turkish Civil Law, Cadastre Law, Land Registry Law, Soil Conservation and Land Use Law, Agricultural Reform Law on Land Arrangement in Irrigation Areas, Forest Law, Pasture Law, Zoning Law, Review of Bylaws and Regulations, human rights and real estate ownership relations, restrictions on real estate ownership, Human Rights Conventions, Decisions of Human Rights Courts, and their impacts, land ownership, acquisition and development of land ownership real rights to be established on land, the right of ownership over the land and its protection, the right of possession of the land and its protection, cadastre and land registry, principles of land registry, the register and other documents constituting the land registry, evaluation of land registry examples in different countries, types of land ownership: co-ownership and joint ownership, fragmentation and consolidation of lands, evaluation of the easement rights that can be established on the land, usufruct right on the land and its scope, the right of superficies on the land and its scope, the mortgage right on the land and its scope, the real burden and its scope, land acquisition by citizens, foreigners and legal entities and land grabbing, evaluation of the relations of land ownership and its legal foundations with economic development, analysis of case studies, review of secondary materials and judicial decisions, identification of problem areas, evaluation and discussion.
Learning Outcomes 1) Obtains knowledge about property rights and protection.
2) Discusses ownership issues on land.
3) Understands the place of division and merging of lands in Turkish Law.
